Terms & Conditions & Returns Policy

Welcome to HP Nutrition! We’re committed to providing you with high-quality sports nutrition products. Please read the following Terms & Conditions and our Returns Policy carefully before placing an order.

1. General Terms and Conditions

Agreement to Terms: By placing an order with us, and by ticking the box at checkout, you agree to be bound by these Terms & Conditions.

Age of Consent: By placing an order with us, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.

Product Information: While we strive for accuracy, product descriptions, images, and nutritional information are for informational purposes only. Always read the label of the product you receive before consumption.

Health and Medical Disclaimer: The products sold on our website are food supplements and are not intended to diagnose, treat, cure, or prevent any disease. Always consult with a healthcare professional before starting any new diet, exercise, or supplementation program.

Pricing and Payment: All prices are in EUR (€) and include VAT where applicable. We accept all major credit and debit cards.

Order Confirmation: An email confirmation will be sent to you after your order is placed. This is for confirmation purposes only and is not acceptance of your order. A legally binding contract is formed only when we send a “Confirmation of Dispatch” email. It is your responsibility to carefully review the order confirmation and notify us immediately of any errors (such as an incorrect delivery address or product details). Once an order has been dispatched, we cannot guarantee that changes can be made.

Order Modifications: Once an order is placed, we are unable to modify it. If you wish to make changes, a full refund will be issued upon your request, which will allow you to place a new order with the correct items.

2. Shipping and Delivery

Processing Time: We aim to process and dispatch all orders within 1–2 business days.

Delivery Estimates: Delivery times are estimates and may vary due to courier delays beyond our control.

Delivery Address Responsibility: You are responsible for providing a complete and accurate delivery address at checkout, including house or apartment number, building name, town, and Eircode (where applicable). Parcels will be delivered to the address provided. HP Nutrition is not liable for any loss, theft, or damage once the parcel has been delivered to the address supplied, even if collected by a third party. If an order is returned due to an incomplete or incorrect address, we will contact you once it arrives back at our warehouse to arrange reshipment or refund. Additional shipping charges may apply for reshipment.

Address Requirements: Eircodes alone are not sufficient for courier delivery. A full street address or property name must be provided to ensure successful delivery.

Proof of Delivery: For all parcels, photographic evidence from the courier or confirmation of drop-off at the provided address is considered proof of delivery.

3. Returns and Refunds Policy

This policy is designed to comply with the EU Consumer Rights Directive and the Irish Consumer Rights Act 2022, ensuring a fair and transparent process for both parties.

3.1 Unwanted Products (Cooling-Off Period)

Right of Withdrawal: You have the right to cancel your order for any reason within 14 calendar days from the day you receive the goods. You must notify us by email at [email protected] within this period.

Return Window: After notifying us of your cancellation, you have a further 14 days to return the goods to us (up to 28 days total from delivery).

Condition of Returned Products: Products must be returned in their original, unopened, and sealed condition. For health and hygiene reasons, we cannot accept returns for items where the tamper-proof seal has been broken or the product has been opened.

Return Shipping: You are responsible for the cost of returning unwanted items. We recommend using a trackable shipping service.

Refunds: Once we receive and inspect the returned item and confirm it is in its original, sealed condition, we will issue a full refund to your original payment method. This refund will include the original standard delivery cost you paid. The refund will be processed within 14 days of our receipt of the returned goods.

3.2 Faulty, Damaged, Incorrect, or Not as Described Products

Damaged or Faulty Products: If a product arrives damaged or appears to be faulty, you must notify us immediately upon delivery by emailing [email protected] and provide clear photographic evidence showing: the outer delivery box (all sides), the internal packaging and protective materials, and the affected product. Claims submitted without full packaging evidence will not be accepted.

Incorrect or Not as Described: If you receive a product that is incorrect or does not match the description in your order confirmation (including incorrect flavour, size, or weight), you must contact us within 48 hours of delivery. An appropriate remedy (replacement, refund, repair, or price reduction) will be provided only after the product has been returned and inspected. Customers must not open, use, consume, or dispose of the product before contacting us.

Mandatory Return of Products: All faulty, damaged, incorrect, or not-as-described products—including perishable goods—must be returned to our warehouse or sent for manufacturer inspection before any replacement, refund, or other remedy will be issued. This applies even if the product appears opened, partially used, or spilled, as we must verify whether the issue is due to manufacturing defects or damage in transit. Only items that have been fully discarded or consumed prior to notification are not eligible for any remedy.

No Disposal or Consumption: Customers may open and reasonably inspect or try the product. If a problem or defect is identified, the product and its packaging must not be consumed, discarded, or disposed of before contacting us. All items must be retained and returned for inspection if a claim is made. Disposal or discarding of any part of the product before contacting us may invalidate the claim. This policy applies to all products with no exceptions, as the returned items are required for testing and verification.

Return & Replacement Process: For accepted claims, we will provide a prepaid return label at no cost. A replacement will be dispatched only once the returned item has been scanned into our warehouse or verified by the manufacturer. If a replacement is unavailable, a refund or alternative remedy will be provided in accordance with Irish and EU consumer law.

Return Shipping Costs: We will cover the reasonable cost of return shipping for accepted claims. Where a prepaid return option is provided, reimbursement for alternative return methods will not exceed the value of that option.

Manufacturer Inspection: Where necessary, returned products may be sent to the manufacturer for inspection to verify the issue before any replacement, refund, or other remedy is issued.

3.3 Packaging for Returns

Packaging for Returns: For all returns, please do not stick labels or tape directly onto the product, product bag, or branded box. Place the items inside suitable outer packaging to protect them in transit. Returns received with labels or tape on the product packaging may not be accepted.

4. Ownership and Risk

Ownership: Ownership of the products passes to you once we have received full payment.

Risk: Risk of damage or loss remains with HP Nutrition until the goods are successfully delivered to the address you provided, or to a person you nominated to accept delivery. Until delivery is completed, we are responsible for the goods in transit.

5. Refund Process & Timing

Refund Method: Refunds are issued to the original payment method unless otherwise agreed.

Processing Time: Refunds are processed within 14 days of the goods being received back at our facility or upon provision of proof of return (such as a tracking number). Please note that bank or card processing times may apply and are outside of our control.

6. Free Products, Samples & Promotions

No Monetary Value: Any item marked as a “Free Item” is provided at no cost and has no monetary value.

No Individual Refunds or Exchanges: Free items cannot be refunded, replaced, or exchanged individually.

Return of Associated Items: If the main product is returned for a refund, all associated free items must also be returned in their original, sealed, and re-saleable condition.

Subject to Availability: Free items, samples, and promotional gifts are strictly subject to availability and may be withdrawn at any time without notice.

Customer Choice at Checkout: Certain free promotional items, such as shakers, are offered through a drop-down menu at checkout. Customers may choose to accept or decline these items. If the “No” option is selected, or if the free item is out of stock at the time of order, it will not be supplied.

7. Your Statutory Rights

Nothing in these Terms affects your statutory rights under Irish or EU law. Under the Irish Consumer Rights Act 2022, you may be entitled to remedies (repair, replacement, refund, or price reduction) where goods are faulty, not as described, or not fit for purpose.
